Terms of Service

The terms for keeping their voice close

A plain, fair set of terms for preserving and asking from your family memory vault. We will keep them simple as Hearthsay grows.

This is a draft set of terms and should be reviewed before production launch.

1. Accepting these terms

By creating a Hearthsay account or using the service, you agree to these terms. If you are setting up a vault on behalf of your family, you agree to them for that vault. If you do not agree, please do not use Hearthsay.

2. Your account

You are responsible for keeping your sign-in secure and for activity in vaults you own or administer. You must be old enough to form a binding agreement in your region. Hearthsay is intended for adults preserving family memories.

3. Consent and the people you record

You may only preserve the voice and memories of someone with their permission, recorded through the Consent Passport, or with the clear agreement of the family responsible for that loved one. Consent can be revoked at any time, which turns voice features back off.

You agree not to use Hearthsay to impersonate anyone, to script a loved one saying words they did not say, or to make a person appear to speak in a way they did not consent to.

4. Acceptable use

Hearthsay shares family memories and emotional guidance. It does not provide medical, legal, or financial advice, and you agree not to rely on it as such. You agree not to upload content you do not have the right to save, and not to use Hearthsay to harass, deceive, or harm others.

Generated answers are AI-generated from saved memories and are grounded only in what your family recorded. They are an aid to remembering, not a substitute for a real person.

5. AI, MCP, and bring-your-own-AI

In-app answers come from Hearthsay’s included experience, from included AI credits, or from your own connected AI provider. If you connect your own provider, your selected memories may be sent to that provider, and that provider’s terms also apply to that use.

MCP connections expose your approved memory vault to external assistants you authorize. You are responsible for the connections you create and can revoke them at any time. Unlimited third-party AI usage is available only when you connect and pay through your own provider.

6. Subscriptions and trials

Hearthsay Basic is offered with a free trial, after which it is $1.99/month unless cancelled. You can cancel anytime. Billing is handled through the app store or payment provider once integrated; during early access, billing may be in a demonstration state and no charge is made without telling you first. Prices and plans may change before launch.

7. Your content and data

Your family memories belong to your family. You retain ownership of the recordings, transcripts, and memories you save. You grant Hearthsay the limited permission needed to store, organize, transcribe, and play back your content so the service can work for you. Hearthsay does not sell your data and does not use your recordings to build public or shared voice models.

You can export your archive and delete your content or account at any time, as described in the Privacy Policy.

8. Service availability

Hearthsay is provided on an as-is basis during early access. Features may change, and the service may be unavailable at times. We will give reasonable notice of significant changes where we can.

9. Limitation of liability

To the extent permitted by law, Hearthsay is not liable for indirect or incidental damages arising from your use of the service. Nothing in these terms limits rights that cannot be limited under applicable law.

10. Changes and contact

We may update these terms as Hearthsay grows, and will note the update on this page. For questions, contact the vault owner inside the app or Hearthsay support.
